We have been in an estate/real property litigation that has been ongoing for years between siblings- 3 to 1, 3 agreeing to share some of the attorney fees. Although we have been asking my husbands sister for detailed bills and all documents, correspondence, etc., all along, she has never supplied them to us and now suddenly refuses to. She expects payment of $34k with the only disclosue of the bills being cancelled checks and a general ledger. The sister has independently settled her portion of the real property but we have not had the same opportunity. Even in light of us potentially still needing the documents, corespondence, etc. and the fact that she refuses all copies of any documents, can we be forced to pay the bill? She has hired a lawyer that says that the sister will be putting a lein on our property if we do not agree to pay the portion she claims we owe. Can she do that without disclosing a detailed billing and not supplying us with what she wants us to pay for? Also, she has recently tacked on another $5k which means she is claiming that another $15k was spent somewhere/somehow to be split 3 ways (charging us the $5k as our third). We agree that we owe her reimbursement for some attorney fees but we have no idea which ones because she refuses to disclose the detailed billings … read more
