In Louisiana, My middle sister attempted to change my mother's estate and medical POAS. My mother was competent when she assigned her 3 daughters her POAS, in matters she assign us to handle for her. A clause that majority vote on any business to carry the action at hand. 7 years later and my mother was in progressive decline with dementia with severe deficits in short and long term memory and cognitive disabilities, my middle sister took her to an attorney (in violation of mother's writen directive, that prohibits any POA to take my mother to an attorney or have her sign legal papers without first giving advanced notification to the other POAS.). My middle sister took my mother to an attorney she was personal friends with and told him her 2 sisters ( who were POAS) had removed $160,000 each by check from my mother's financial account. And she got nothing. She advanced the narrative that we manipulated my mother to make out these checks in her compromised state of dementia. She said this money was missing from my mother's account. This was false. We had a family conference, 8 months after my father's death, to discuss my mother's desire to divest herself of owning any raw property and paying taxes on property that she owned via my father. This particular property was co owned by my father and my middle sister and her husband. My father was an attorney and listed this property in his estate papers and noted the property's value to be $850,000 or more. My mother decided to dispersed this property in totality as an inheritance to my middle sister which she wanted. She inherited a highly valued piece of property. My older sister and I given $160,000 as a part of our inheritance in compensation of this property. We all agreed on this, and my mother wrote 2 checks ,in front of all of us, to my oldest sister and me. My middle sister's husband set the dollar amount on the property. My mother then transferred the property to my middle sister in it's entirety. My sister remarked mother should give her the property and not be considered a part of her inheritance. My mother was not at that time was not suffering from dementia and was in full possession of her faculties, as it was just 8 months after my father's death. As 7 years had past and my mother was severely compromised cognitively, my sister took her to the attorney to sign papers to change the POA from 3 to one, and that one would be my middle sister. I was alerted by the assisted living director that my mother was signed out as going to see this attorney. My sister signed her out just minutes before I arrived to take my mother out to lunch. I intercepted my mother and my middle sister at the attorney's office. The attorney told me what papers he had prepared to change the POA to my middle sister and questioned me as the the money missing from my mother's account. He said 2 checks were written for $160,000 as part of my father's estate and my sister, who was sitting next to me was given property. He asked my sister did she receive property. She answered “yes” and ran out of his office. I proceeded to show 2 letters from my mother's Doctors who explained her advanced disabilities. My middle sister told the attorney that it was my mother's wish to change POA to just her. The attorney apologized to me and said he was misled by my middle sister. … read more
