he had the ira before we married but sinse married took money out and put in joint checking I'm still entitled to half the remaining ira

If he had a balance in it prior to marriage, that would be his separate money. But if he contributed to it during the marriage, that is marital money. If some of both, it would have to be calculated how much is his separate money and how much is marital money.
