The brother of a deceased person, represented by an attorney, petitions the county court to be appointed administrator of an estate of a deceased person, and is waiting the court's decision as to appointment. Then, he has his attorney intervene in the eviction hearing before a JP on the part of the person being evicted, where the widow of the deceased person is attempting to evict from property owned jointly by her and the deceased because the evictee has been complicit in individuals stealing property belonging to the estate (weapons, a tractor, etc., and has otherwise been diminishing the estate. I find it a conflict of interest on the part of the attorney (and the potential Administrator), to represent an individual who is destructive to the estate, and living rent free on estate property, where they (the brother and the attorney), have petitioned another court (in the same county), to administrate the estate, and in that administration protect the estate and ensure a fair and equitable distribution of the estate. Is it just me, or this wrong, and what if anything, would be what the attorney is doing be called? … read more
