My father/mother set up a living trust several years ago,

Customer Question

My father/mother set up a living trust several years ago, naming both my brother and myself equally to divide assets. My brother passed away 2 years ago, my mother is in a nursing home with dementia. My question is my dad put the home in my mother's name. When she passes away, will the living trust still protect the home, even though my brothers name is included?

What does the trust state about what happens if a beneficiary passes away?

Are there successor beneficiaries named?

Are you saying that the house is not in the trust, but rather in mother's name personally?

Is father still livign?
