If a persons will has not been probated, is it as if he has

Customer Question

If a persons will has not been probated, is it as if he has left no will legally
JA: Because laws vary from state to state, could you tell me what state is this in?
Customer: Oklahoma
JA: Have you talked to a lawyer yet?
Customer: No - we hadn't thought it necessary. But a problem has arisen as to ownership of 8 acres of mineral rights that my father in law held and we didn't know about until a few years ago. We are having to list this on my mother in laws DHS papers - and we don't know whether to list it all or only half
JA: Anything else you think the lawyer should know?
Customer: Not that I can think of - we just want to do what it right

Probate can be very difficult, especially when grieving for a lost loved one;

can you please tell me the following:
was the will recently discovered? If not, is there a reason it was not probated?

how long ago did the person pass?

the mineral rights, or the will, was not known about until recently?
