Is it okay for estate lawyer to demand a payment upfront to do the estate tax etc to settle end of life papers for state and federal concersn?

It is not illegal or unethical. However, make sure you have a written retainer agreement which specifically provides for the duties to be performed and that no additional charges will be owed.
