What are the chances or creditors mainly credit cards being paid in full in probate? My husband died recently and I hired a an estate atty but he gives me vague answers. My husband left 2 adult children and the atty is saying they are entitled to 1/2 of any assests not taken by creditors. I lived with my husband for almost 8 years and paid on all the bills. We were married in July and he died in November without a will. His children did not help pay funeral costs or anything and they want a bunch of my husbands belongings. I feel horrible and received a large bill from attorney today on Christmas eve and a request for an additional $1500 to go to probate and maybe more charges?
