If there is no will, and there is an heir that cannot be found, the Judge will have to appoint an ad litem attorney to do a search for that heir and either find them or testify that they could not be found. The attorney ad litem fee can be reimbursed by the estate. Once the attorney ad litem does their search, and the step child does not turn up, then probate can proceed.
