Hello again,
If you are going to go ahead and file the petition to open the probate case, then you would have to send her notice of the petition, but you don't have to use a process server. You just have to send out notice to all "interested parties" that you are filing to open the estate and be appointed Administrator.
But there is nothing that would keep you from filing the probate petition on 6/30 or sooner if you wanted to because you don't have to wait on her to see if she is going to actually comply with your attorney's request.
