Good day,
The home I live in, (since 2006) has the bank loan in my father's name. As of September 2014 the deed is in my name. My father died in September 2013 since then I have tried to work with the Bank of America to assume the loan without any success. Currently, the home is in foreclosure. I am working with a real estate company to do a short sale. My mother is the beneficiary and refuses to sign the documents allowing the real estate company to deal with the property due to instructions she is getting from my sister, (who has no use for me). My sister, who has no legal or real estate training believes that by signing the documents needed for a short sale she somehow becomes financially responsible for the loan that is and always has been in my father's name. The real estate company has tried to educate my sister about the facts without any luck. Is there a law or factual information that I can provide to her so this process can be imitated?
