Here you have several issues .Let's go through them.

First her house is exempt under Medicaid Rules.It is not counted as a resource.Once she receives benefits Medicaid and then she deceases Medicaid may be able to assert a lien on the property to recover costs of care.The fact that it is currently in a living trust may not protect it from Medicaid estate recovery.

Your remedy here is a fair market sale of the property from her to you with her carrying a non resalable note.You do say a 30 year note and she wills you the note.This avoids Medicaid issues because you won the property and Estate Recovery will have no claim.

The income for her gets reported.It may be possible to work with her retirement income because she is going to be real close to the income limits if not over.It is often possible with some retirement plans to give it up if necessary in order to qualify for Medicaid.You need to contact her retirement plan and ask about his option and whether it exists.

Finally I recommend a NAELA lawyer.They have specialized training in dealing with your problems here--sheltering funds while making her eligible.Medicaid qualifying annuities are an excellent means to shelter funds these days.These annuities have a short payback, think legal money laundering where the funds are paid to her in say 90 days and are then exempted from Medicaid and may be a possibility.
