My father passed away in March in Tennessee this year my sister

My father passed away in March in Tennessee this year
my sister is executor of his estate there is an outstanding hospital bill and there is no longer any money in any of his accounts is my sister liable for my fathers hospital bill.

If there were no assets left in the estate then neither of you are liable for the remaining debts of the estate. You and your sister are only liable to pay debts up to the amount of assets that were in the estate.

forgot to ask an important question my dad had a death benefit from Calfers in California that no one new of till a few days ago is that considered part of his estate and therefore what ever money there is from Calfers would go toward payment of hospital bill


That is a very good question. It will depend on whether the death benefit is payable to named beneficiaries or if it is payable to the estate of your father. If it is payable to named beneficiaries then it is not subject to the estate or payment of the medical bills. If it is payable to the estate then it must be used toward the medical bill.
