Father left property in trust to 3 children. It was a testamentary trust (in his will). Do we want to see a real estate lawyer or an estate lawyer about this?

You will need to meet with an estate attorney. Since the property was left in a testamentary trust, the will will need to be probated in order to place the property into the trust. The will was already probated. (The firm that wrote and probated will in TN is not helpful ). Does the fact the will was probated make a difference?

I apologize for the delay in responding. There is some difficulty with the life chat function

Since the will was already probated, the trust should have been established as part of the probate. A tax ID number should have been established and the property placed into the trust. If this has already occurred, the trustee can operate the trust and retain counsel only if a situation arises that requires counsel. If it is not occurred, you will want to retain an estate attorney
