VerifiedThe French lawyer was correct in that it does depend on where you are located when you pass away. However, it also depends on where your assets are located as well. If you have assets located in France such as real estate you would need to deal with those under French law and if you have property in MA it would have to be probated in MA. Thus, the wills will not cancel each other out, but you will have to have them set to work with each other to make sure they each cover the assets in each place. The best thing is to do a simple will in each place and not worry about the international will and you can set up a trust in each place. The will and trust in MA, of course depending on the total value of your estate, would cost you about $2000. I do not know what they charge in France for similar service. In the MA will/trust it would refer to the French property and the French will would refer to the US property/trust so they would work together.
