First, anything that has a beneficiary (insurance or bank/investments) never becomes part of your mom's estate. If there is a will, then it is up to the party alleging there is a will to produce the will. If your sister is not disclosing the will, then what you and your other sister can do is file to open probate in the probate court in the County where your mom was living when she died. Once you file to open probate then if there is a will your sister would be bound to produce the will and an executor would be appointed who must provide an accounting of the estate. If no will is produced, then an administrator will be appointed and would have to perform the accounting for the estate and the descendants (all three of you would split the estate equally, not including any policies where you were named as beneficiaries as discussed above). If during the accounting you find they took money from the estate you can bring that up in probate court and seek to get that property returned to the estate or deducted from their shares. You would likely do best hiring a probate attorney if she has not opened probate and is not going to open probate.
