Hi, I have a new startup...

Hi,

I have a new startup for-profit company website. We are a talent/entertainment hosing site, show-casing new talent. My customers pay our company for monthly membership dues. I need to post many links to other commercial sites on our site, in order to benefit my site''s members regarding vendor/supplies resources, and also to us advertise our site.
The links are also for-profit companies.
Can I legally post other company ''s links on my website, without asking for and being granted their express written legal permission, Will I be liable and open to a lawsuit by these companies if I just randomly post their links without their permission?

In regards XXXXX XXXXX question about sharing what’s called ‘Reciprocating Links’, no, our new site will have no pornographic, or otherwise suggestive related material of any capacity. It is a family-oriented, moral, clean-cut site, focused on main-stream folks who are in the talent industry. We will be constantly closely monitoring all postings of text, photos, audio and videos, and our administrative disclaimer will be very clear to all members… if they violate our rules, there membership will be suspended for one month, and if it happens a 2nd time, there account will be terminated. Our talent categories will include the following:
Music, Fashion Modeling , Fashion Design / Style
Acting / Theatrical / Musical / Dance
Comedy / Mime / Magic / Celebrity Impersonation / Variety , Art and Photography.
We understand that this encompasses a wide-range of talent, open to much interpretation, but we will be closely monitoring all member graphic images, and reserve the right to immediately remove nudity or other suggested material from our members’ user profiles, , before it is ‘made live’ on the Internet. Hope this answers your questions.

Hello Linda,

I have never met anyone who wouldn't want their link posted somewhere, especially if their site sells something....every link to them is potential profit. The only time I've seen objections to this is when the linking site is distasteful or pornographic in nature.

When you speak of reciprocating links, I'm assuming you mean a 'I'll post your link if you post mine', in which case you will have to contact the site and see if they would be willing to trade links. If they don't respond, I wouldn't take it to mean that they don't want to be added, but they may be too busy or too large to get back to you, and you may not be able to expect a link back, especially if you are just starting up.

If you post links, and someone doesn't want you to post their link, they will likely send you something to that effect, simply asking you to remove it. No one is going to file a lawsuit over a link that benefits them in the long run. If you think they might, as I said before, it's simply a matter of dropping them an email to gain their permission. Let me know if you have any other questions.
