My parents are dentists and they had a dental office which they closed because of COVID 19. They applied for PPP (Paycheck Protection Program) funding and received about 50k in funds for it. As you may or may not know, these funds must be used for payroll expenses. When they received the PPP funds, I was put on payroll for approximately 2 months per the PPP program requirements. After those 2 months, I applied for unemployment and was approved. I was approved for the PUA (Pandemic Unemployment Assistance) benefits. However unfortunately I made a big mistake and did not read everything thoroughly for the PUA benefits. For the PUA benefits, if you put that you made over about 47k in 2019, you get awarded the maximum weekly benefit amount which is $450. However if you put that you made over 47k in 2019, it turns out that you must provide income verification for 2019 showing that you made over 47k. If you do not provide income verification the EDD website says the following:The Employment Development Department (EDD) is requesting income documentation for calendar year 2019. This documentation is required under the Federal CARES Act of 2020 to support the increase of your Pandemic Unemployment Assistance (PUA) weekly benefit amount from $167.00 to $450.00. The EDD increased the weekly benefit amount based on the 2019 annual income you provided when you first applied for PUA benefits. You must prove that you earned at least $46696.04 in 2019 to keep your increased amount. Submission Deadline You have until December 14, 2020 to submit documents verifying your income for 2019. Penalties If you do not provide the required documents to verify your 2019 income within 21 days: The EDD will decrease your PUA weekly benefits to an amount as low as $167. Any future PUA payments will be paid at the lower weekly benefit amount. You must repay the benefits that you were not entitled to. The amount would be the difference between your current weekly benefit amount and the decreased benefit amount, for each week you were paid.If your income is from self-employment, the documents you provide must show your net income. If your income is from regular employment, the documents you provide must show your gross income. Acceptable 2019 income documents may include: Federal tax return (IRS Form 1040, Schedule C or F) State tax return (CA Form 540) W-2 Paycheck stubs Payroll history Bank receipts Business records Contracts Invoices and corresponding documents Any other documents to prove your 2019 incomeAs I am sure you have figured by now, I did not make more than 46k in 2019 or anything close to that. On my unemployment claim, I put that I made 77k. I dont know why I put that and obviously did not think about it when i did that. I have been receiving UI benefits for about 24 weeks now. I was sent this income verification message about 2 weeks ago and i have no idea what to do. I do not want to get in any trouble and i dont want to lie or fabricate anything. What should i do at this point and moving forward? I believe I can pay back the amount that i would need to pay back (450-167)= $283. $283 x 24 weeks = $6,792. However, I am not sure if that is how the EDD will calculate it or what they will do if/when i dont provide income verification. At this point I am trying to minimize the damage and also see if there is any possible solution or way to maybe minimize the amount I would have to pay back. And also to see if I have any other options or what I could do at this point since I messed up. Today is Friday and the deadline is Monday to provide the income verification that I do not have.
