I got addicted to pills after 9 months clean. Work had no idea I went to Hr and asked for help 4 days later I was in rehab. She said nobody had to know that it was a medical leave. I returned back to work to everybody knowing and making fun of me. I was a great worker never had a report and customer tipped me excellent and I even got good reviews online. I feel they somehow they broke hippa laws by dicu

Response 1: Unfortunately, eventhough your boss/HR person badly mishandled your medical information, there was not HIPAA violation because HIPA generally does not to apply to employers. Your employment records are not protected by HIPAA. Click here for more information. However, you need to go to your HR director and report this HR worker for egregious violation of your privacy.

I tried to meet up with her multiple times but she was always out my last day I called her and explained I was being mistreated by all my bosses and a even a few coworkers knew. I was wrongfully accused of being high when I was on meds that my insurance put me on and I was going to meeting and try to live my best life. Until I couldn’t take it anymore I was told that since it was brought to there attention I would be viewed any different and it was confident. I don’t know what to do I’m phsy said I should sue of look into it

They slander my name and mistreated me for seeking help. I did it the right way got a medical leave and all but but they did everything to push me out the door. I needed the insurance for my 1 year old son.

Response 2: If you are being slandered, then you can file defamation lawsuit against the people defaming your name and lying about you being high on drugs when you are not.

Generally, in order to win a defamation suit, you must be able to prove all of the elements of defamation. Generally, you must be able to prove (1) that a defamatory statement was made against you (false things said about your drug habit); (2) that there was a unprivileged publication of the statement to a third party (false rumors circulated about you); (3) if the defamatory statement is a matter of public concern, fault amounting at least to negligence on the part of the publisher--this may not apply to if you are not a public figure; (4) then finally you have to prove that you suffered damages as a result of the defamation (reputation in the community damaged, jobs/business suffered, etc.)

You would need to consult with a civil rights/privacy Attorney in your area to assist you in putting your claim together as these cases can be very difficult to win. Interview at least three Attorneys and/or review their web sites to see which one will be a better match for you. You want to look for someone who is not too busy to handle your case; someone who will return your phone calls in a timely manner, and someone who will give you prompt updates on your case.
