My boss has asked...

My boss has asked me multiple times about my sex life as well as where i st stand in my relationship with my kids father

Lawyer's Assistant: Have you discussed this with a manager or HR? Or with a lawyer?

I had a sit down with my district manager as well as my boss a couple of days ago and spokes with my boss one on one in private about it. but i dont feel as though it helped. she hasnt since asked me those kind of questions but im at a point where i no longer feel comfortable working for the company for many reasons

First time she asked me about my intimate life was a few months ago, again a couple of weeks later and then about 2 weeks ago she questioned me about my relationship with my kids father and why he was driving my car, and continued to tell me that i better not be planning on having any more kids with him. Considering this is my life and that is exactly what I plan on doing, that was kind of the last straw for me. These are conversations I don't feel are even relevant to my job description.

No, instead I spoke to her, after she had taken me into the office to discuss the fact that my performance as well as my demeanor at work had changed and both her as well as my district manager wanted an explanation as to why.. At this point, I politely asked my DM to allow me a moment to speak to my boss in private so that I could better explain what my problems really were. I felt that was an inappropriate time to discuss a matter as serious as this to someone in a much higher position without first making an attempt to address the matter with her (my boss) directly and hope for a resolution....

Ok. For any claim of sexual harassment it has to be reported directly to HR or a higher level supervisor to allow the company to investigate the claim and take protective action on your behalf.

The best course of action is to make the complaint in writing to HR so they can investigate.

Usually when there is sexual harassment investigation it is kept confidential and you and the accused are interviewed along with any witnesses.

I've spoken to three people about about the way that she has spoken to me or treated me and 2 people about the questions she's asked me about my personal life and sexual relations

I also spoke with a District Manager about 6 months ago about the fact that I felt as though I was not being treated fairly by the store manager and how there were previous relations between us outside of work as far as hanging out or talking, and how I felt that it had caused friction in the work place and was also preventing me from a promotion that i was promised by the store manager. She heard me out and a couple of days later promoted me. The last thing she said to me was to end whatever friendship I thought I had with Christina (my boss) and to leave my person life at the door and away from work. I took her advice, and since then I've done my best to do just that. but eventually came the questions about personal matters and then questions about other things outside of work until eventually I hated coming to work, it showed, which lead to the sit down just 3 days agowould she be considered a witness also? considering i did speak to her about what my problems were before with the same store manager. Except at this point the questions hadn't begun yet?

It depends on what happens after the investigation. If they do not do any sort of corrective action and it occurs again then you would have a claim.

This is why I am seeking legal advice because the whole story is so much. My problems and the fact that i feel uncomfortable with this job are not just with my boss, but with the company. She has told multiple district managers things about my personal life, and long story short they all believe I am some sort of victim of abuse. she has made it impossible for me to ever be able to go to work and feel motivated or confident about being there. instead I feel small and embarrassed. action against her would not make me feel better about going to work. I no longer want to work for the companyso telling a district manger 6 months ago about how the store manager and I had a Friendship beyond work at one point and now it was affecting the way I was being treated, and nothing being done to the store manager, is not considered, not taking any sort of corrective action? and things getting worse to the point that Im speaking with you isn't things occurring again except worse?

Severance would be they pay you a certain amount of weeks of pay in advance with the agreement that you get unemployment and you leave the company.

If I don't want that.. A couple of weeks pay?? For them making me feel like I hate my job and now just want to leave the company and have to completely start over somewhere else. That's not fair enough

Then I would recommend you go to the EEOC (which is the government entity that investigated sexual harassment as a prerequisite to filing a legal claim) and allege you reported the conduct six months ago to management and they didn’t take corrrective action and the harassment continued and you want to bring a legal claim. They will investigate the claim and either give you the right to sue or offer to bring the lawsuit through their agency.

The EEOC can ask you to allow them to bring the claim if they find enough evidence or you have the option of bringing the claim your self through a private attorney.

I think you have enough evidence for the EEOC to permit you to bring a legal action. On the damages side it would be up to the jury what that is worth. Typically I like to have a termination as part of the damages but I’ve seen decent jury awards without a termination.If I was able to answer all your questions tonight please accept and rate my performance.
