I have worked for my previous employer as an IT consultant for 9 years. My employer is in New Jersey and my project was in NY. I was working from the client office in NY and in the past 3 years, I have been working remotely from my home in TX. When i joined the company, i had paid vacation as part of my package and i was told it get carried over. Everytime i ask for my vacation time, i get the carried over hours. My last email from them states that I have 650 vacation hours. After my project has ended in end of December, my contract was over and my company refused to pay me for my unused vacation. I escalated the issue to the consultant director and after few weeks of research, she responded saying that she cannot find any documentation that indicates carryover allowances over and above the company's policy which is 10 days, therefore they will pay for 80ht unless I have sthg in my contract stating vacation carry over which I don't. The company still owe me over 500h of vacation hours, they never mentioned in the past that they don't carry over and now I feel cheated for my unused vacation bec they failed to inform me of a major change in their policy. So I would like to know if my employer has the right to not pay me for my carried over vacation. If I file a law suit what are my chances to win the case and is there any labor law that protects my right in this situation.… read more
