I work in Information...

I work in Information Technology. Recently the agency I work for as brought in a outsourcing company that has taken over some of the duties I used to do. On Monday I was told I now report to the outsourcing company. It's not a situation I'm not comfortable with. I'm also wondering if it's even legal, being told that I report to someone who is not even an employee of the agency I work for.

Lawyer's Assistant: Have you discussed this with a manager or HR? Or with a lawyer?

I've discussed this with HR but they haven't gotten back to me yet. This is by first step as far as getting legal advice.

Lawyer's Assistant: Are you an "at will" employee? Do you belong to a union?

I can certainly understand your frustration with this. However, this is nothing illegal about outsourcing some of an employee's responsibilities or having an employee report to outsourced management. In fact, this is becoming an increasingly common practice. I'm not saying it's right, but it absolutely does not violate any law.

For a hospital here in LA. Three years back our department
I am Respiratory Therapist for a hospital here in LA. Three years back our department got outsourced to save the hospital money. Out of 80 therapist working for the hospital at the time, 15 of us got retained. The new outsourced company kept us to train the new Therapist coming aboard. The only downfall was that my pay went from $36/hr to $22/hr. After two years working for this new outsource company my hourly went to $30/hr, but for some of co-workers their pay stayed the same ($22/hr-$24/hr). In the beginning of this year the hospital wanted to get back their Respiratory department, which they did. They retained mostly everyone that currently worked for the outsourced company and all of the old retained Therapist, under one condition, that our pay stays the same. We all agreed to it, assuming that now as a Hospital employee, union will fight for our wages to increase and be up to par with the surrounding hospitals. ($34/hr-$36/hr). Till this day, that hasn't happened. Many Therapist have quit. Desperate for Therapist, the hospital started a new grad program to fill the demand. So now we have 20+ fresh out school new grades, which we (retained) train. We love the fact new grades are getting the opportunity to work and help us out, but their starting pay is $34/hr. Which is a lot more than the rest of us. Is this considered Unfair? and is there anything we can do about it. … read more
