I was living in Texas when I signed a noncompete with my new employer. The terms are 24 months (with a diminishing time period "as defined") and operating/serving no business or person within 100 miles of Albuquerque. I have to seek employment else where, but I can't find anything else since my job is so specialized and there are no major cities that offer my services within driving distance in NM. I noticed that the time period "as defined" includes a phrase : "...after employee completes each successive one-month of employment with licensure." The issue is that NM doesn't offer licensure for my position. I carry a national credential which - is not licensure. Does this phrase invalid the non-compete agreement?… read more
