There is nothing in the law that creates an entitlement to vacation or holiday pay. This is entirely up to the employer. If the employer doesn't have a policy of paying out that time, they don't have to do it. If they have a policy of paying out vacation only when it is applied for, and it wasn't specifically applied for, they can refuse to pay it.
