My company may be for sale and I'm looking for a sample of a retention letter to retain certain employees during the transition process or enhanced severance payout. Which is better for this situation and the difference between both letters

Lawyer's Assistant: Have you documented this or discussed it with HR?

Lawyer's Assistant: Is the employment agreement "at will," union, full time or part time?

I believe what you would need is an employee retention agreement. An Employee Retention Agreement is designed to help retain valuable employees during periods of transition. If your company is being sold, you can use an Employee Retention Agreement to entice valuable employees to remain at the company, so that you can keep running your business without interruption. Here is a sample of an agreement.https://www.shrm.org/resourcesandtools/tools-and-samples/hr-forms/pages/cms_015128.aspxI hope this clarifies. Please don't forget to rate the question with stars so that I will receive credit and payment for assisting you with your question.

M. The field I work in has client's, I was put on a failing
The field I work in has client's, I was put on a failing client only to find it a few weeks later, the client was pulling their account (due to lack of the way the account had been handled by our company). Our company encouraged everyone to apply for a job with the client that is leaving or our employment would be terminated at the end of client end date, which is Feb. 28. We all applied with the client as advised, but they are only taking the people that have been on the account for a year or longer. I had not been on the account but for couple months when we were given all this information, knowing I would not be hired, I applied anyhow. The company new all this was happening before they put me on this account,, I feel like I was thrown in the account to be eliminated from our company. I have been offered 5,000 dollars to stay an work on account until the client leaves on Feb 28. Then I would receive my 5,000 dollars taxed @ the bonus rate of25%. My management is calling it Retention Pay and HR is calling it Severance Pay and they will not deny us of Unemployment pay. I am 63 and I feel like I was thrown in this group, just to let me go. They are still hiring people and younger people. I HV almost 4 years tenure with this company and they tell us still how many people they are going to be hiring to bring the company back up to and will be moving to a new office in May. They have even had me apply for other jobs in our Dept. But of course I do not get hired for them. I am the oldest in this group and have never seen anything like happen before. I consider the 5,000 dollars as retention an they are not giving any severance package. After taxes, it is barely a months pay. I know with my age, it will take me much longer to find another job. I feel like it is age discrimination, or am I just taking it too personal. … read more
