My friend works as a caregiver. The agency she works for

My friend works as a caregiver. The agency she works for sends her out to various clients. They told her that if she works for 2 different people in the same week totaling more than 40 hours they do not have to pay her overtime because she has worked for 2 different people and they aren't billed for the overtime hours so she doesn't get paid overtime. Is this legal?

Customer: New York state. Nassau and Suffolk counties
JA: Is the employment agreement "at will," union, full time or part time?
Customer: She is not Union. They call her when they need her to work. Currently she is working 36 hours a week for one person and 3 hours with another. Now they are looking to have her work with a new person also.
