I am paid salary and my company gives 60 hours of discretionary time each year. Well each day I called in sick my hours were taken from discretionary, but I have went past the 60 hours and they have docked my vacation time. Is this legal?

This is an unfortunate situation, unless your employment contract or hr policies state something different the employer would be able to do this, under the law in Florida, sick time and discretionary time are not regulated by law, but by the employers policy, if the policy allows them to do this this would be legal.

You should ask to review the company policy and see if they breached the contract.
