Are you talking about taking vacation days away when an employee leaves or as some sort of punishment?
No, that can't do that. Under Florida law, the definition of wages includes all remuneration for working, which covers earned vacation days. Fl. Stat., Section(###) ###-####/a>. An employer can no more take away earned vacation days than he could ask you to repay him for work you've already done. Any affected employee could sue the employer for the value of those vacation days. It's a violation of federal law for an employer to retaliate against an employee for exercising his legal rights, so they could not terminate or demote anyone for suing them.
