We have a independent contractor that we have just received a wage garnishment on. Do we have the right to garnish in this situation?

No you need to write the judgment creditor and explain that they are an independent contractors not employees and not subject to wage garnishment.These funds are not wages but rather income to a contractor as they are self employed not employees under the law.Again they are not subject to withholding you just need to advise them that they are 1099 contractors.
