I live in New York and work well known NYC hedge fund.

Customer Question

I live in New York and work for a well known NYC hedge fund. I am considering running for political office while maintaining my employment at the hedge fund. My employer has stated reservations about me running for office, but I'd like to know if I could be fired for running if I campaign on my own time and don't use the firm's resources. I have a meeting with the firm's compliance team next week and I'd like to have a legal argument prepared in the event they make an ultimatum.

Unfortunately they can ask you not to run and can fire if you choose to ignore their request unless you have an employment agreement.

What about NY Labor law 201-D, which states, "No employer may discriminate against an employee or prospective employee because of an individual's legal political activities including running for political office..."?

New Expert here. Has the employer explained why it thinks that you running for office would adversely affect the employer?
