I work clinic as a nurse. I was recently hospitalized

Customer Question

I work for a clinic as a nurse. I was recently hospitalized with tia and htn crisis. The nurse navigator health benefits nurse for the clinic accessed my health record through the clinic and the hospital. Then she reached out to another employee about my condition and emailed her. Is this legal? I never gave her permission to access my personal file nor did I give her permission to look at my records at the hospital. What can I do about this?

Did the nurse have the responsibility to verify your benefits?

If she had no need to know then yes it is a hipaa violation. You can notify the state nursing board and the Dept of Health and Human Services. There is not really a basis for an actual lawsuit though based on what you have told me.
