The Amended HIPAA Privacy Rule gives health plans and self-insured employers broad authority referred to a “regulatory permission” to get information without consent that is far more extensive than is needed for billing or any other reason related to a specific individual’s health care. This would include what type of medication the employee is taking. Generally, however, most employers have their employees sign a waiver release form so everyone knows they have rights. It is possible your employer has such a release form if they in any way contribute to your health care cost for coverage.
