Hello and thank you for your question. As you might imagine, this is an extremely complicated legal issue. The argument in court would be that the claim did not accrue until you tried to make the claim with the plan, and that procedure was exhausted, hopefully within the SOL period. This is likely the only possible winning argument which is a long shot. I hope this helps.
