what are the terms of the non compete? geography? time? limited to employer clients?
As a general rule, courts will not enforce a non compete unless very limited in time, space and scope. Where limited to company clients, a court would enforce, BUT if customers choose you, a court wont interfere where it is the customer, not the defendant, seeking the services.
practically, suing for an injunction is time consuming, expensive and rarely successful, so usually not pursued. Kindly rate me positively.
