If an employee of who is working in a hospital billing department and handles insurance money and social security numbers etc. has been working for 9 months and after someone auditing the employees personnel file finds that a background check was never done on that employee and proceeds to do one 9i months after they are working there and the criminal background check shows 19 offenses of money theft (she served 2 days in jail and the rest was probation and she pleaded guilty on all offenses and it was 10 years worth and the last time being 2-3 years ago), can this employee be terminated without retalliation. This employee is Afro American and doing a decent job at work. In the meantime, $9,000 was stolen from an office next to hers that she has access to, but this cannot be proven that she took it.
