I and 500 employes, which included 240 clinicians were
laid of as of November 24th 2013 from Visiting Nurse Service of New York (VNSNY) as a reduction of workforce. Although the lay off class included other minorities such as individuals from the Philippines, majority of the employees that were laid off were black. Black Americans, Philippines and other minorities are a group of individuals who are mostly passive and will allow psychological oppression from companies in fear of job security and retribution.
I believe racial discrimination
played a huge role in deceptive hiring practices, which included using United Federation of Teachers (UFT) union to "legitimize" certain staff positions such as "Nurse Consultant" and "Care Manager." The aforementioned positions were deceptive in nature: They were used to create the illusion that the "Nurse Consultant" and "Care Manager" positions were permanent. UFT went as far as to deduct union dues from our final vacation payout. We were deceptively hired to perform illegal activities such as initiating Medicaid Long Term Care cases starting at or around January 2013. When concerns regarding "clients who did not qualify for services were brought to management", employees were met with threats of corrective action, disciplinary meetings and harassment from upper management. After VNSNY profited from slave labor
including working overtime without compensation, going to clients home with bed-bug infestations, and creating an environment filled with harassment from upper management, VNSNY threw 500 employees out on the streets like animals. VNSNY gave some of its employees a lousy 3 months severance pay
starting 10/24/2013 of which you had to work the first 30 days; health insurance that expired on 01/31/2014, which equal the sum of an initial unemployment
claim. This so called "severance" package was paid out on a bi-weekly basis for three months. This would prohibit employees from applying for unemployment since in order to be eligible for NYS unemployment, you would of have had to earn less than $405.00 in a week.
The New York Times down played the article as if the company did us a favor. The individual who wrote the article Nina Bernstein stated in her article "staff reduction represented less than 3% of the century-old agency 19,000 employees, and included some working in its certified home health agencies financed by Medicare. The statement attributed the layoffs in part to changes in state and federal reimbursement act under the Affordable Care Act, and said that VNS was actively transforming the way it delivers home and community based care." That is a blatant lie because the 2012 Annual Filing for Charitable Organization CHAR500 form published on the NYS Charities Bureau Website reported net payment for Medicare was 31%, Medicaid 59% and third party payers 10%. In 2012, net pay for Medicare was 34% an increase, Medicaid 46% a decrease, however an increase to 20% of third-party payors and self pay.
Michael Bernstein Senior Vice President of Marketing and Chief Marketing Officer, sent a company-wide email, which gave employees detailed instructions to notify him if news media were to contact employees. VNSNY uses Manatt, Phelps and Phillips (MPP), a law firm to do its political lobbying. Carol Raphael was one of the Chief Executive Officers for the Visiting Nurse Service of New York from 1989-2011. MPP have been lobbying for Visiting Nurse Service of New York since 2009. MPP raised 70,000 for 2012-2013 of which $2500 was given to Pres. Obama, but not reported on CHAR500. As of 2013, Mrs. Raphael joined Manatt Health Solutions as a Senior Advisor. Manatt Health Solutions is division of Manatt, Phelps and Phillips. If the Affordable Care Act was responsible for mass lay offs, then why did Visiting Nurse Services of New York raise money via MPP in 2012 to the Democratic Congressional Campaign, to fund the Health Insurance Reform otherwise known as the Affordable Care Act?
I feel as if me and 500 employees were raped by not only by VNSNY management but by UFT aka American Federation of Teachers and elected political officials. UFT special operations Anne Goldman was quoted saying "do not use contract language as job security." I believe a horrible injustice has been done to VNSNY employees who simply wanted to live up to the company's mission statement: "To Achieve the Best possible outcome for each patient, Exhibit respect for our colleagues and to work together as a team toward common goal." VNSNY failed to live up to its mission statement "work together" and "respect to our colleagues" when management created a psychologically hostile
environment. I believe each employee is entitled up to 1 year of pay for violating the Fair Labor Standards act
and intentional infliction of emotional distress due to political and corporation bully. Please help us if you can because writing this letter brings tears to my eyes.
