I am an independent contractor as a Teacher of the Visually
I am an independent contractor as a Teacher of the Visually Impaired. My company is called Exa Curtis Contract Vision Services. My first contract is with a company I still work for. My fourth contract was with a company to provide braille production and evaluation services to a school district near my home. I worked for this company and there were many issues with the hours reported, even tho' the president of the company who generated the google doc forms could have easily pulled up the history of the forms to check what I reported. She repeatedly called me and said things like, "things just get messed up on the internet" or somehow the documents got duplicated". Then, just before Christmas she calls me and tells me she overpaid me. As a result, I did an evaluation in January to "repay her the hours". After that, I really wanted to just be "even" with her and not work in the red. So, I repaid her the amount she said I owe her. In her contract, there is a clause that I asked her to remove stating that I can't work for anyone else in that district for two years after my last assignment with her. Now, the school district has reached out to the first company I still work for and asked if they have a TVI to do evaluations. That would be me! I checked with the school district and they love the work I do, so that was not the problem. I think they don't want to deal with the person who messed up the hours and I suspect shuffled hours around to "fit" other things such as "orientation and mobility evaluations that were done before they were approved. This is speculation on my part,, I only know this, because I know the TVI who works for the district who needs help. I know this is a long story, but I want to do the work and help the district . There is a shortage of TVI's in the area, but I don't want to get sued. I guess my question really is, because I worked for the company who wants me to do the work first, does that "trump" this awful clause? Thk so much, Exa … read more
