is smoking still a protected class. I am being told that an employee does not have to hire a person if they smoke and that it is not discrimination any longer. I was told the insurance industry was responsible for these actions?

My apologies but smoking has never been a protected class. Employees have always been able to and permitted to discriminate against individuals who smoke. An employer really does not have to hire someone who smokes, that is not a violation of any state law.
