Good morning,

I'm sorry to hear of your dilemma.

Under Michigan law, regardless of whether you are terminated, or voluntarily resign your job, your employer must legally pay you your final paycheck no later than the next regular payday. (Mich. Comp. Laws §§ 408.474, 408.475.)

I wish you the best in 2010.

Best regards,

Is the employer allowed to ask me to hold a paycheck till a later date?
Expert:  LawTalk replied 7 years ago.
Good morning,

While it is no unlawful for an employer to ask you to hold a paycheck until a later date, you are under no legal obligation to do so if the paycheck is your final paycheck. You may negotiate it when it is presented to you. If the employer does not want you to cash the check before the regular payday, then the employer should not give you the check until that time.

If the paycheck is not payable by the regular payroll date, then your employer can be found in violation of Michigan laws.

I wish you well.

Best regards,
