I have been employed in the same position as a contractor to
I have been employed in the same position as a contractor to a federal facility for over 10 years. The first contract was awarded in 2007 to Company "A" and was lost to Company "B" in 2016; then, in August of 2017, Company "C" was given the contract.Throughout my employment with Companies "A" and "B," I accrued vacation based on my years of continuous service. If I was an SCA employee at that time, I was unaware of it, but that may be my fault and not theirs, since it didn't seem to affect me one way or another. When Company "B" won the contract, they honored the time served with Company "A" as far as the vacation accrual rate (that is, I was receiving 3 weeks' vacation with Company "A," and Company "B" continued to give me 3 weeks' vacation). For both companies, vacation was provided at X.X hours per pay period on an accrued basis, and was paid out at the end of the contract.Company "C," however, has clearly listed me as an SCA employee (Wage Determination No.: 2015-4603), with the information in my offer letter as follows:"Vacation Leave: 3 weeks vested annually on contract anniversary dateYou will be provided Vacation Leave annually on your anniversary date with the SCA contract, consistent with the amount specified in the SCA contract, based on your years of service on the contract."Company "C" is considering the "contract anniversary date" as the date of employment with Company "C," not as the date of employment when I started working at this job in 2007. Therefore, they are withholding all vacation accrual until August 2018.My question to you is: Since I have been working continuously on the contract since 2007, isn't 2007 my "anniversary" date? Shouldn't I already be "vested" based upon my continuous years of service?I've read CFR 4.173, and it seems clear except for paragraph (a)(4), which states, "Some fringe benefit determinations may require an employer to furnish a specified amount of paid vacation upon completion of a specified length of service with the employer, for example, "one week paid vacation after one year of service with an employer".However, the Wage Determination that applies to me (2015-4603) states: "VACATION: 2 weeks paid vacation after 1 year of service with a contractor or successor; 3 weeks after 10 years, and 4 after 20 years. Length of service includes the whole span of continuous service with the present contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility. (Reg. 29 CFR 4.173).”Can you please advise? I don't want to risk my job with my present employer unless I know that my information is accurate. … read more
