Mother is terminally ill and a person not related went in her email account and deleted all e-mail from her aol account then emptied the trash can there was legal docs and other important docs in those emails now we don't know what to do
JA: How long have you had this issue with your A.O.L. account?
Customer: We believe they were deleted on November 3rd
JA: How do you access your email most often? On a phone or tablet, or through a web browser?

JA: What troubleshooting have you tried?
Customer: We haven't this is our first attempt to recover

Customer: No we just need the emails restored

I'd be more than happy to assist you. Unfortunately once that individual emptied the trash, the items are lost forever. I know that's not the answer you're looking for but those are the facts. Since AOL is providing email as a free service, they have no obligation to restore email from backups. However there's no harm in asking AOL support by clicking HERE.
