A school is trying to suspend and expel my daughter for something he didn't do

What exactly is the underlying reason for all this--what happened?

My daughter got into an argument with a girl in the hallway and the girl tried fighting her but a teacher separated her from my daughter but my daughter never touched the other student. But she got suspended for fighting in school and now they are threatening her with expulsion.

We talked to a lawyer but he charges $2500 and we don't have that much and I went on the ACLU website but was confused on who to contact

Okay, did you talk to the teacher, the school, the principal, or not yet? Is the other student also being disciplined?

I talked to an assistant principal and yes the other student got a suspension and a hiringhearing*

That's what they sent us in the mail but she didnt try to hurt her she kept telling the other student to back up

Hi,

The next step would then for you to contact your school district superintendent and appeal to them over the review. The school ultimately has the right to discipline as they see fit provided that the behavior is reasonable. The fact that both students are being disciplined is actually the proper process and gives you less basis to challenge but you can still contact the superintendent to overrule the principal and the process. Giving your child a hearing is the proper step under 'due process' and you would also have a right to appeal if the decision goes against you.

EDIT. Before you posted the answer I was discussing the superintendent--it appears that the hearing will be with that person. You may want to try to get an earlier hearing to see what other options may be available for you and your child.
