My child is a special ed student in high school who is turning 16 before the end of this school year. We live in NY State where the drop out age is 16, but I was told that in our school district students must stay until they are 18. My child’s anxiety and depression is getting worse and is caused by attending a regular education high school where the work is too hard and the stress is causing severe problems.

I havent spoken to an administrator because I would like to know our rights before I give them information. Ive tried unsuccessfully to have my son be switched to an easier “track” or program but they insist that he will need a diploma in order to get a job after hs. If my son winds up in psychiatric crisis because of school stress, they will just try to put him in a school for kids with psychiatric issues which are notirious for making things worse. My son is on the autism spectrum, and testing shows an “average” IQ but his many learning disabilities and adhd And stubborn personality make it extremely difficult to thrive in school . I want to know if i can legally sign him out of school at the end of the year. Home schooling wouldnt be possible, and the district doesnt want to show that they have high standards for all learners because of special ed laws, but my son is already eligible for OPWDD and will get supported employment and services (he is currently getting self direction support services .

*typo: The district doesnt want to change my son’s program to an easier one because special ed law demands high standards. He is not eligible for alternative assessments. What are his options ? School has always been a place that is a horrible environment for him and its only getting harder and more stressful. What can be done to avoid common core as well as being forced to go to school until age 21? Or even 18 (his current program ) Homeschool wont work because he wont pass tests. The i ly way homeschooling would work is if he had teachers come to the house. Realisticly he needs to drop out asap, and be homeschooled from now until the end of the school year.
