My student loans are...

My student loans are in default. A large amount of fees has been added to the principal/interest. The only options they are offering are consolidation (which i don't want to do) or voluntary payment.

Lawyer's Assistant: What state is this in? And when did the issue begin?

I went to school in DC

Lawyer's Assistant: Have you spoken to a local attorney or school administrator? What is your ideal outcome for this situation?

Ideally, I would like the added fees waived since I started receiving bills before graduation (they had the graduation date wrong)

Her school is public school in San Diego. It is hybrid on-line school. My daughter is junior at high school and has ADHD and SPD. Her IQ is supposed to be about 116. She gets easily distracted, but she is very motivated and wants to get good grades to get in to UC. She has IEP accommodations such as longer time allowed for tests; allowed to take several breaks, late submission of work, and for the school to notify us if she misses any assignments every month. We requested the last accommodation, because the biology teacher last year notified my daughter that she was missing 10 assignments one week before the school is over. My daughter said she turned all in, and I remember her doing some of the assignments. After I start asking questions to the school, a couple of items surfaced from the teacher's file. He gave her make up assignments; so, she dropped everything (no practice for skating) and completed the assignments. The last day of school she was standing in line to turn in all the make-up assignments, but he did not accept her assignments because he claimed that she was 1 minutes late. We complained to the IEP teacher and the principal without avail. Her biology grade she got “B”, but it was “A” till last week of the year. Because of this incidence, I requested the notification of missing assignments monthly during the IEP meeting in last October. Since then I talk with IEP teacher; however, the school does not follow this accommodation. When I remind them, they say “yes, we will next time”. Now we printed her transcript last month, we found her Chemistry was “I”. She sent several messages asking the teacher to confirm he received everything for the first semester, but he never responded. So, she asked him at school what is her grade for Chemistry, he responded “A”. I sent IEP teacher asking why she got “I” in Chemistry, IEP teacher emailed me back saying she got “D” because some assignments are missing. We do believe she turned in everything that had asked her to do. But it is always her words against teachers, and no power to proof she is telling truth. Even there were something missing, if the teachers follow her IEP to notify her the missing assignments, she would have completed. My daughter is so frustrated because the teachers told her was getting “A” s, but it ends with completely different. She was so discouraged and currently has no motivation to work hard. I also talk with the IEP teacher, and she assured me that she is capable of getting all “A”. Also, IEP teacher asked her if she wants to switch to non-A through G, then she does not stress out. My daughter answered “No” because she wants to go to UC. It almost feels like a ADHD/SPD kid should not go to UC. We had a teleconference with State advocate, but she called 1 hour early, and I missed the call and the advocate indicated me to file a complaint on-line. We are not sure if the State really takes serious about ADHD/SPD kids who cannot get “A” because the school does not follow the IEP. … read more
