He isn’t seeming extra hyperactive, he’s asleep on my lap. No panting. And the chocolate available to him was one of those giant sized hersheys kisses but I don’t know how much was gone before he ate it and my son can’t remember.

Ok. Since he hasn't had any vomiting or diarrhea so far, and is not having any panting or hyperactivity, I'm hoping it wasn't too much. I would continue to monitor him throughout the night (you might want to set a few alarms). If he doesn't have any vomiting or diarrhea, panting or hyperactivity by morning, then he should be okay. The milder signs of chocolate toxicity are vomiting/diarrhea, so if you see these, be on alert for the more serious signs of panting/hyperactivity and if you see those, get him to an emergency vet right away for treatment.
