On May 1st my husband, who typically stays with his mother elsewhere when we are fighting, came back to our apartment and destroyed the interior furniture, beds, pictures, etc. He was diagnosed with schizoaffective disorder long ago. He also has a Traumatic Brain Injury.I could tell he was having delusions that I had been unfaithful (untrue). I called the police but by the time they came, he had left. I was asked if I wanted to file charges, and emotionally, I said yes and completed a statement. So did my roommate, who only overheard anything, because she hid in a different room.Immediately after, my husband voluntarily admitted himself inpatient to a psychiatric hospital, where he is to this day.The Harris County DA picked up the charge. He’s now charged with misdemeanor Assault on a Family Member on the basis of one cop’s testimony because and I quote, he “almost” shoved me into a wall causing pain. I cannot remover if I put that into my statement and I disagree; I never requested EMS, there were no marks and I did not go to a hospital.The police did not take photos of the apartment. My roommate’s statement said she only “overheard” commotion, which is accurate since she was hiding in another bedroom. But she put in her statement that she saw him push me into a wall; but again, she as hiding and only overhead anything.My husband was subsequently charged with misdemeanor Assault on a Family Member. His only prior conviction is DUI in 2014.Here are my questions:1) I know it’s the state who has picked up the charges, but will they take his mental illness and subsequent stay in a mental hospital into account?2) the cop and state have he knowingly and willfully cause me bodily injury. Firstly, I disagree with “knowingly and intentionally” because it was clear to me as his wife of 20 years, that he was under a delusion and not in control of himself. Also, he had had zero sleep for 4 days, further adding to my belief about his delusional state. No sleep considerably worsens any disorder with psychotic tendencies.3) an EPO was granted for the full duration of the case., as a condition of bail. Can I change or get it dropped in any way?4) I know I can be subpoenaed to testify, but I don’t remember what was in my statement because I was so emotional. I would like charges dropped and to see him. A separation will create undue hardship on our family, because we are both on disability and therefore on fixed income. We WILL lose our apartment, so I myself will be homeless.5) What can I do about anything at all? Who do I call? Where do I begin?Thank you for your time.
