I'm not sure what yuou are asking. In general, if a criminal can't make bail or if no bail has been set because of flight risk, the defendant remains incarcerated until the case is over.

I think you misunderstand. Probable cause has to do with arrest.  We are past that now.  If he is in jail, then a criminal complaint or indictment has been filed.

Are you asking about bail or how to accelerate the trial, so he can be tried and if innocent be acquited and released?

Defendants at these hearings, represented by attorneys, receive the information that informs the state’s case, and they can call and cross examine witnesses.

The system relies on a public-safety assessment (PSA), a tool that allows the judge to make a reasoned decision about detention or release.  So, that must already have been done, and the prosecutor already showed that the defendant is a public danger or a flight risk.

An indictment means he has been charged by the grand jury with a felony.  Therefore, he is facing at least a year in prison.

Sexual assault, sexual assault and child endangerment are indeed harm to the victim. Extremely harmful.

Basically, whether to grant pretrial release is in th eCourt's discretion, and is reversible only for abuse of disretion.  That is extremently hard to show.

He may try an appeal, as unlikely to succeeed as that is.

He has to exhaust all state remedies before he can file a federal habeas corpus writ.

This must already been presented to the Court by his defense attorney. Also, for sexual assault, actual penetration and ejaculation is not needed.

At this point, defense counsel may file an appeal at the state level.  Assuming it is denied, counsel would then seek leave to appeal to the NJ Supreme Court.  Then, he can file a writ for habeas corpus at the United states District Court for the District of New Jersey.

My above comment states the procedure which must be followed going forward.  He has to convince the Court, not me.

His attorney already must have done his best to convince the trial Court, and failed.  So, the next step is an appeal.
