While incarceration is a possible sentence for anyone convicted of a criminal offense, that doesn't mean it's likely. In my experience, a person in this situation who gets charged with a crime can usually get a plea bargain involving probation and restitution to the government. The government has a better and a quicker chance of getting its money back with a charge like this if the defendant is able to remain at liberty and work.

When you have to appear in court, if you can retain a lawyer, make sure that you have one with you so that he can negotiate something for you. Otherwise, if you cannot pay a lawyer, plead not guilty at your arraignment to keep all of your rights open and then let the judge know you can't afford a lawyer and ask him to appoint you free one.

You're going to have to pay the government back whether you get charged or not. The penalty/restitution will only put the government back financially to where they should have been in the first place. That won't necessarily stop them from having you prosecuted, since the act itself was unlawful. In general, coming to terms with what you owe and agreeing to a plan gives you the best chance of avoiding criminal charges, but it doesn't always work.
