A grand jury is a tool of the prosecutor's office. The prosecutor runs it, determines what evidence the grand jury sees and hears, and all proceedings are secret.

A grand jury doesn't decide on guilt or innocence. They just decide whether the DA's evidence is sufficient to support a felony charge. Essentially, an indictment means that IF the DA can prove its case beyond a reasonable doubt then it will result in a felony conviction. An indictment requires a very low standard of proof.

A grand jury doesn't even need to be unanimous in their determination. A majority decision is good enough.

There's a saying in my state that a good DA can indict a ham sandwich. That's only a slight exaggeration. If a prosecutor wants someone indicted, he almost always can see to it that it gets done.

The odds of the mother's boyfriend getting indicted are very, very, very high.
