This is a driving while license suspended in the third degree I'm wanting to represent myself

Thank you. The attorney needs to obey the Judge's order and if it was ordered that they not discuss the case with you and to only set up the competency evaluation, that is what the PD must do. If the attorney fails to comply with the court order, they can be held in contempt of court. If you have an issue, you can motion the court or ask your attorney to do so and explain to the Judge what you want to know, need to know and ask why your attorney can not speak with you. It does seem odd for a case like this the Judge would not allow your attorney to speak with you so you need to find out why and your PD should explain it, if they know.

the case is in pre trial is this the time to fije an order to dismiss with affirmative defence going with a bill of particulars

The attorney is not going to be able to proceed until the results of the competency evaluation are known. If you are found competent to stand trial, it would be then that counsel would raise any defenses that could result in a dismissal of the case. In this case, it would appear that if you license was not suspended at the time, evidence would be obtained to show that and if you have a defense to raise, it may be for trial.

The criminal traffic is held in a courtroom that is under admiralty law once the judge makes an order now jurisdiction is under common law

A competency evaluation is an assessment of the ability of a defendant to understand and rationally participate in a court process. If you are found to be competent, the case can proceed. If not, they State may not be able to. I do not believe this is a writ and merely an order as a result of your public defender having concerns, since they would need to adress it.

It was the judge who ordered the evaluation this is the second public defender the first public defender removed himself from the case because of conflicting circumstances I am trying to see if they have jurisdiction since I I am not a public official nor was I doing Commerce I have never had a driver's license thus far I have never contracted with the state of Washington

In order to drive a vehicle on the roadways, you must be licensed. You shared that you were charged with driving on a suspended license, so you would have had to have a license, for it to be suspended. If you never had a license, you could be charged with driving without a valid license and the Judge can order this test if there is a concern. You can be charged for driving on the road without a valid license. That is illegal.
